1. About these Terms

 

The Elemental Atelier is the online shop of Quantumpunk Creative LLC, based in Kalispell, Montana, United States. In these Terms, “we,” “us” and “our” mean Quantumpunk Creative LLC.

 

These Terms cover elementalatelier.com, purchases from our shop, member features and inquiries. Please read them before placing an order or using these features. By placing an order or using these features, you agree to these Terms. Our Returns and Refunds policy also applies to shop purchases. Our Business, Site and Privacy Policies page explains our business practices and how personal information is handled.

 

Product-specific information provided before purchase and any separate written project agreement also apply. Nothing in these Terms limits rights or remedies that cannot legally be waived.

2. Products and product information

 

Our current shop offers printed products made to order. Please review each listing’s description, materials, measurements, sizes and care instructions, and check your selections before ordering.

 

Product images may include digital mockups. Screen settings and the printing process can cause slight differences in color or placement. This does not excuse an item that is defective, incorrect or materially different from its description. Please contact us if you believe there is a problem.

 

We may update our catalog, availability and prices for future purchases. Those updates do not change the price of an order already placed. If an error affects your order, we will contact you to resolve it. We will not charge a higher amount or substitute a materially different product without your agreement.

 

3. Ordering and payment

 

By completing checkout, you agree to purchase the items you selected for the total shown. You must have the legal authority to place the order and use the payment method provided. Please give accurate contact and delivery information and review your order details carefully.

 

Prices are in U.S. dollars unless expressly stated otherwise. Available payment methods, delivery options and applicable checkout charges are shown before you pay. Payments are processed through the checkout services offered for your selected method.

 

If we cannot fulfill an order, we will notify you and provide the refund required by applicable law. An inquiry, quote request or item placed in a cart is not a completed order and does not reserve stock or production time.

 

4. Production, delivery and order changes

 

Production and carrier transit are separate stages. Our current printed products are made and fulfilled with the help of Yoycol and delivery providers. Please contact The Elemental Atelier, rather than a production provider, for help with your purchase.

 

Delivery options and charges available for your order are shown at checkout. If you need an item for a particular date, contact us before ordering. An inquiry or requested deadline does not establish a delivery guarantee.

 

Contact us promptly if you need to change or cancel an order. We will check its production status; changes or cancellation may not be possible once production has started. This does not restrict a cancellation or refund you are entitled to by law.

 

If we cannot ship within the applicable promised or legally required period, we will provide the notices, cancellation options and refunds required by law. Our arrangements with production and delivery providers do not remove our obligations to you.

 

5. Returns, refunds and order problems

 

Under our voluntary returns policy, we do not accept returns, exchanges or refunds for a change of mind, a customer-selected wrong size, or a different color or design preference. This does not affect the exceptions below or any cancellation, return, refund or other rights provided by applicable law. Making an item after it is ordered does not, by itself, remove statutory consumer rights.

 

If an item arrives damaged, defective, incorrect or materially different from its description, or appears lost or undelivered, contact us with your order details and a description of the issue. We may request relevant photos or tracking information.

 

Our standard reporting periods are 14 days after delivery, or 30 days after the expected delivery date for a missing order. Please report problems as soon as you notice them. These periods do not limit rights or remedies provided by law.

 

Depending on the issue, we may replace or re-ship the item, offer a comparable item of equal value with your agreement, or issue a refund when replacement is not practical or the law requires a refund. Your remedy is not conditional on a production or delivery provider reimbursing us.

 

Contact us before returning anything. If we require a return because an item is damaged, defective, incorrect or materially different from its description, we will provide instructions and cover reasonable return shipping costs. Do not send an item to a manufacturer or another address without our instructions.

6. Custom projects and inquiries

 

Submitting an inquiry or requesting a quote does not place an order or reserve production time. A custom project or collaboration needs a separate written agreement covering its scope, price, timing, revisions, cancellation and usage rights before paid work begins.

 

Send only images, references and other materials you own or have permission to share. Submitting reference material does not transfer its ownership to us or automatically authorize its use in a product. Any permissions needed for a custom project will be addressed in its written agreement.

 

Do not include passwords, payment-card details or unnecessary sensitive information in an inquiry.

 

7. Artwork and intellectual property

 

Artwork, designs, text, images and branding on this site belong to their respective owners. Buying a physical product does not transfer copyright or commercial reproduction rights in its artwork or design. Any license for creative work must be agreed separately in writing.

 

Do not reproduce or commercially exploit protected site content or designs without the rights holder’s permission, except as permitted by law. These Terms do not restrict honest reviews or other legally protected uses, or claim ownership of your reviews.

 

8. Accounts and acceptable use

 

Provide accurate information and keep your sign-in details private. Contact us if you believe someone is using your account without permission.

 

Use the site lawfully. Do not impersonate another person, misuse another person’s information, upload malicious code, attempt unauthorized access or interfere with the site’s operation. We may restrict access or remove content where reasonably necessary to address such misuse or comply with law. An account restriction does not remove rights relating to an existing purchase.

 

Member profiles are public by default and may be visible to site visitors. Information you put in a public profile or comment may be seen by others. Review the privacy policy before using these features and do not post information you want kept private.

 

9. Privacy and third-party services

 

Our Business, Site and Privacy Policies page explains how information is handled for orders, accounts, inquiries, newsletters and site activity, and how to make a privacy request.

 

The site uses Wix and other service providers. External websites and third-party payment services have their own terms and privacy information. Their terms do not replace our obligations to you for purchases from The Elemental Atelier.

 

Newsletter subscription is a separate choice. You can unsubscribe from marketing emails using the unsubscribe option. Necessary communications about an order or account may still be sent.

 

10. Changes and your legal rights

 

We may update these Terms and will show the revised effective date on this page. We will provide additional notice or obtain consent when required by law. Changes will not retroactively remove rights relating to an earlier purchase.

 

Nothing in these Terms excludes or restricts consumer protections, product warranties, cancellation rights or remedies that apply by law. If a provision cannot lawfully be enforced, the remaining provisions apply to the extent permitted by law.
